Any part of the emissions system renoved will be a failure. Will a coded out EGR be a failure? Well how would the tester know if it's been coded out?
No software is checked in an MOT.
Cut open DPFs are a definite failure though, and a mil light on is also a failure.
Sorry for no definitive answer but I hope this helps.

Just to add to this thread that mine has just had it's MOT and the EGR removed and coded out was not an issue. I don't know if it helped but I did have the engine cover on which partly hides where the EGR would be.
