No MOT insurance invalid?...LCR

hi guys,
I have a bit of a major dilema that needs to be sorted out....on wed night some idiot decided it would be fun to do a hit and run on my car causing the whole of the drivers side to be ruined....i think i need a new drivers door, and the rear door wont open too...

Anyway, the car was parked up on my drive, it had been for a couple weeks (im lucky because i can walk to work, and everyone i know is in walking distance), due to the fact i knew the MOT was due at the end of nov...now i have insurance and tax...but funds have been super tight at the mo due to me having to have 2 brand new tyres on the rear because of the forthcoming MOT (£280)...i was just gonna get xmas out thew way then get the MOT....

But due to the accident i am now very very worried that they may not pay out....the car is left at my place of work for security reasons as the window does not shut. They are collecting it Monday, but i have no idea how all this works due to this being the first claim i have ever had. I realize i have to pay my excess after the work is completed, but what happens if they complete the work and then ask me for the MOT which obviously i cannot provide...will they give the the bill for £2500 or whatever it will cost.....am i better off now just cancelling the claim and buying 2 new doors and get them painted and fitted myself and keep my 4 years no claims?......

I have read my ins documents and it doesnt say anywhere about lack of MOT etc.....

please help me guys, if you think im screwed then tell me straight...:cry:

MOT is not top of their requirements, but they may ask for it.

Some insurance companies could try to argue out of the payment, while others will say that its not required or affects the claim as the car having an MOT or not has not been a factor in the accident.
(for example it wasnt due to brakes failing)

Other companies may state you need to pay a larger access or they would reduce their payout by 10% or the like.

So if i was you, id simply be honest with them, make them aware, (but that you look after the car, its taxed and services etc etc).
A middle ground would be to call and ask what documents they will require as you simply want to be organised before the repair.

Do the doors open and close? you may find it passes an MOT anyway. As i dont think operating windows are a requirement.

Im sure no matter how tight money is you can find £40 for an MOT..

Omn a side note, id try to figure cost of getting repair done yourself, - then facrtor in excess payment and 2-3 years of policy being more expensive and compare.

yeh im trying to get quotes for 2 new doors at the mo......they defo do not open. You wont believe me but i have had 2 apointments booked for an MOT and twice something came up and i had to cancel...my attitude being that i never use the car nowadays so if i leave it on my drive it will be fine till after xmas....

Im sure you dont wanna hear this but it has been a mega expensive month for me, £5000 for final payment on car, 2 tyres £280, spending money for my holiday that i booked a while ago, various outgoings and a service too...hahahahah

I didnt see it as £40 MOT i just see it as they may find things wrong which is even more money....

I will be honest with them but this sometimes goes against you....if they fix the car, they may not even ask me about the MOT, whereas if they fix the car then ask for the MOT and end up not paying i will have a bill for £2500!!!

without your mot the car isnt legal to be on the road as you know, but yours wasnt on the road so they wont have a problem. Im writing this from work at the minute and I work for aviva who are notorious for not paying out claims if they can get away with it. I quickly called the claims team and they said that they wouldnt not pay out so your insurance company shouldnt be any different.

as long as it was 'off the road' then shouldn't be a problem as it is his insurance paying as it would to a damaged wall or lampost etc or do you now know who it was ?

how the hell did he go down the side of it on ya driveway ?

be honest with em - only way to be sure nowadays

i just tried ringing my insurance company to ask them what documents they need, but they are shut....

This whole situation worries me like mad...im not even sure if the car will be ok yet...the drivers door looks like a normal dent but a few people have said the c- pillar looks bad....

Dont know who it was flapper but it comes out of my ins....although the owner of the unformentioned peugeot was accusing me of all sorts so i said i wanted to ring the police and he soon backed down and became very very helpful.....im sure he isnt letting on what happened....

its a 3 car off road driveway, but only me and the peugeot on it....leaving 1 space and a garden free....the (car???) cut the garden because of the tyre tracks and flattened hedge and rammed my door in....i cant help but think it was pre meditated.....also their is no paint scuffs, bumper scuffs and no paint scratches from my car also which leads me to think it may be a motorbike or quad bike

its a very weird situation, cos there are 2 tracks which arent parallel, but the distance between them is small...so if it was a quad bike then surely the driver would go flying over the car.......also a motorbike would buckle his front wheel so it would be undrivabe....unlesss it was a very very small car, but it has no paint scuffs........

I still cant believe the police didnt wanna come out and check our details, damage, witnesses etc

so someone smacked it by leaving the road proper then and T-boning yours

first call would have been the police as they may have fished a drunk drive out of the hedge down the road for starters

Brett if you cancell your claim the insurance company will have still loged an accident on your record so even if you did cancell the claim you would still have to declaire it in the future, w@nkers [:@]

Also dont forget that MOT's are now done electronical and held on a database, so the insurace company would be able to check for this without seeing the MOT cert.
I'v had a couple of non fault claim's and they have never ask to see my MOT cert, even before they went electronic.

cheers Darren never knew that about the insurance company....very true about the electronic MOT thingy, never crossed my mind tbh....

this whole scenario just really worries me because i knew i wouldnt be using my car anytime before xmas so (naively) i thought the MOT could wait till the new year...i never knew i would be hit on my driveway in the middle of the night.....

Sorry to hear about you car, may sound daft but do any of your neighbours have any kind off CCTV, or if there are any local shops etc..., might be worth going round asking, you never know.

I think thats pathetic about the police not coming out to non-road traffic accidents, whats has to happen for the people who supposedly "protect and serve" to come out and do there job?

Dont think no mot will be a problem as far as your insurance company is concerned as long as its on private land, its only things like getting road tax when you need a valid mot cert/insurance doc, after all you could have declared your vehicle sorn to do a major engine build or the like but you still want to have the vehicle insured while the work is in progress in case of fire or something, however if you cause an accident while driving on public land an you aint got a valid mot then your shafted with your insurance, unless your taking it too or from a mot centre.

Regarding police attendance.

Its a fail to stop traffic accident, police wont come out and see you. Not sure which county your under from your location but possibly Bedfordshire police?

If theres no witnesses/cctv etc, police wont be able to do anything to help you anyway!

I work within a police force, and our policy for fail to stops, is the Victim attends a local police station with insurance documents etc etc and it goes from there.
But as I dont think you fall under my force im unable to advise on the situation.

Im not to sure on procedures within bedfordshire, if you were one county over (herts) id be able to give better advice.

What did they tell you when you went to the police station yesterday? did they give you a crime number at all? Its a difficult investigation as theres no hard evidence that the neighbours saw anything etc or are trying it on with you!

if you got a crime reference no. I would give the police another ring stating that perhaps one of your neighbours saw something and they should send someone round for house to house investigations :)
